Worktaster terms and conditions

This agreement applies as between You, the User of this Website and Worktaster Limited “Worktaster”, the owner of this Website. These terms and conditions shall govern Your use of Our Website. By using Our Website You accept these terms and conditions in full. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon Your first use of the Website. If You disagree with these terms and conditions, or any part of them, You should stop using the Website immediately. If You set up a Worktaster Account You are granted a Licence to use the Worktaster Website and the Services in consideration of Your acceptance of these terms and conditions and the Licensor grants You such rights in consideration of benefits the Licensor receives from making the Licence available under these terms and conditions.

Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:

“Affiliate(s)” Means third party(ies) who Worktaster allows to publish advertising and marketing initiatives on the Website
“Business Partner(s)” means schools and colleges who use the Worktaster system: and businesses, charities and professional organisations offering work experience placements through the Worktaster system.
“Our Material” means any text, graphics, images, audio, video, software, underlying source code, data compilations, selection and arrangements and any other form of information or content capable of being stored in a computer that appears on or forms part of this Website, owned by Worktaster;
“Licence” means access to using the Worktaster system for schools and colleges and other education providers in the UK for a 12 month period
“Facilities” means collectively any online facilities, tools, Services, Material or information that Worktaster makes available through the Website either now or in the future;
“Services” means the Services available to You through this Website, specifically relating to the provision of work experience for young people in the UK and including but not limited to “Worktaster Profile Builder”, “Applications”, “References ”, “Knowledge Base”,
“Premises” means Our place of business located at Worktaster Limited, Stowe House, 1688 High Street, Knowle, Solihull B93 0LY;
“Suppliers” Means any third party who supplies products and/or services to Worktaster, the Website and/or its Users
“System” means any online communications infrastructure that Worktaster makes available through the Website either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;
“Third Party Content” means content owned by a third party supplier of products and/or Services on the Website;
“Third Party Website” means a website owned by a Third Party which is linked to, or from, the Website or on frames within the Website;
“User” / “Users” means any party that accesses the Website and is not employed by Worktaster and acting in the course of their employment;
“Website” means the website that You are currently using www.worktaster.com
“We/Us/Our” means Worktaster Limited, a company registered in England and Wales under Company Number 08965994
“Worktaster Account” means the account that you create on the Website and includes collectively the Data, personal information and credentials used by Users to access Our Material and/or Services or any communications System on the Website;
“WT Profile Builder” means an interactive Tool to enable You to build Your profile and create or store CV’s, references and other relevant media which may be regularly updated in Your Worktaster Account
“You”/Your/Yourself” means any User of the Website.
“Your Content” means all works and materials (including without limitation text, graphics, images, audio material, video material, audio-visual material, scripts, software and files) that You submit to Us or our website for storage or publication on, processing by, or transmission via, Our website.
“Your Data” means personal information and data You supply to us on, or in connection with, the Website as defined by the Data Protection Act 1998 as amended.

1. Worktaster

1.1 This Website provides Services and Materials to assist Users to make decisions in relation to a range of work experience placements and career planning opportunities.
1.2 “WT for Students” can be accessed via the Website to enable Users to:
1.2.1 Access information and advice about work experience placements and how to achieve them; and
1.2.2 Register for a Worktaster Account which will allow Users to access various Tools and Services, including but not limited to, WT Profile Builder/CV Builder”, “WT Search and WT Applications”, “WT Knowledge Base”, “WT Blogs”,” and Our Materials; and
1.2.3 Access to social media, including but not limited to, Facebook, Twitter and Youtube.
1.3 “WT for Schools and Colleges” [See WT for Schools and Colleges Terms and Conditions] can be accessed via the Website to enable Users to:
1.3.1 Assist their students in making good career, Further Education and Higher Education choices;
1.3.2 Access information on “WT Edubase” or make enquiries about Our Services, Tools and Our Materials;
1.3.3 Access to Worktaster Employers/Businesses partners in Your area;
1.3.4 Register for a Worktaster Account which will allow You to buy a licence to be able to invite your students to start a Worktaster Student Account and apply for work experience placements and to be able to monitor the process as this happens;

1.4 “WT for Business” [See WT for Business Terms and Conditions] can be accessed via the Website to enable Users to:
1.4.1 Enable Employers/Businesses to access various management Tools, including Health and Safety protocols, Managing applications and References, Reporting and Auditing and What makes a great work experience placement?;
1.4.2 Access to information about Our Services;
1.4.3 Access to our WT “Bizbase” and Our Materials;
1.4.4 Access to advice about how to manage and facilitate a work experience placement programme;
1.4.5 Access to advice about how to attract suitable candidates;
1.4.6 Access to Schools and College Worktaster Business partners in Your area;
1.4.7 Register for a Worktaster Account which will allow You to post work experience opportunities available within your business, manage applications from students, complete Health and Safety forms, monitor opportunities provided within various departments within your business and access all other Services provided by WT for Business;

2. Age Restrictions

You must be at least 13 years old to use this Website. If You are under 13 You should use this Website only with full supervision of an Adult. We do not knowingly solicit personal information from young people under the age of 13 or send them requests for personal information.

3. Business Partners, Affiliates and Suppliers

These terms and conditions DO NOT apply to Business Partners and Affiliates or Suppliers procuring Services and/or supplying their services in the course of business. If You are a Worktaster Business Partner or Affiliate or Supplier please consult Our Business terms and conditions.

4. Intellectual Property

4.1 Subject to the exceptions in Clause 5 of these terms and conditions, all Our Material included on the Website, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Worktaster, Our Affiliates or other relevant third parties. By continuing to use the Website You acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other laws.
4.2 Subject to Clause 6 You may not reproduce, copy, distribute, store, sell or make profit from, or in any other fashion re-use material from the Website unless otherwise indicated on the Website or unless given Our express written permission to do so.

5. Third Party Intellectual Property

5.1 Unless otherwise expressly indicated, all Intellectual Property rights including, but not limited to, copyright and trademarks, in product images and descriptions belong to the manufacturers or distributors of such products as may be applicable
5.2 Subject to Clause 6 You may not reproduce, copy, distribute, store, sell or make profit from, or in any other fashion re-use such material unless otherwise indicated on the Website or unless given express written permission to do so by the relevant manufacturer or supplier.

6. Fair Use of Intellectual Property

Material from the Website may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply. For the avoidance of doubt You can:

6.1 view and display the content of the Website on a computer screen;
6.2 print individual pages on paper or make a reasonable number of photocopies (or both); and

9. Use of Communications Facilities and Your Content rules

9.1 When using any System on the Website You warrant and represent that Your Content complies with the following rules. Failure to comply with these rules may result in Your Account being suspended or cancelled:
9.1.1 You must not use obscene or vulgar language;
9.1.2 Your Content must not use untrue, false, inaccurate or misleading information;
9.1.3 You must not submit Your Content if it is unlawful or otherwise objectionable and must not infringe any person’s legal rights and must not be capable of giving rise to legal action against any person. This includes, but is not limited to, Your Content that is abusive, threatening, harassing, defamatory, ageist, sexist, racist, maliciously false, indecent, pornographic, sexually explicit, suggestive or inflammatory;
9.1.4 Your Content must not be intended to promote or incite violence or racial owr religious hatred;
9.1.5 It is advised that submissions are made using the English language and We may be unable to respond to enquiries submitted in any other languages;
9.1.6 The means by which You identify Yourself must not violate these terms and conditions or any applicable laws;
9.1.7 You must not impersonate other people, particularly employees and representatives of Worktaster or Our Affiliates; and
9.1.8 You must not use Our System for unauthorised mass-communication such as “spam” or “junk mail”.
9.2 You acknowledge that Worktaster reserves the right to monitor any and all communications made to Us or using Our System.
9.3 You acknowledge that Worktaster may retain copies of any and all communications made to Us or using Our System.
9.4 You acknowledge that any of Your Content that you send to Us through Our System may be modified by Us in any way and You hereby waive Your moral right to be identified as the author of Your Content. Any restrictions You may wish to place upon Our use of Your Content must be communicated to Us in advance and We reserve the right to reject such terms and associated information.

10. Worktaster Account

10.1 In order to procure Services on this Website and to use certain other parts of the System, You are required to create a Worktaster Account which will contain certain personal details and unique User name and password which may vary based upon Your use of the Website. Your User name must not be liable to mislead and must not be intended to cause offense or otherwise be defamatory to an individual or group;
10.2 You must not use Your Worktaster Account or User name for or in connection with the impersonation of any person. By continuing to use this Website You represent and warrant that:
10.2.1 all information You submit is accurate and truthful;
10.2.2 You have permission to submit information on behalf of another User where permission may be required; and
10.2.3 You will keep this information accurate and up-to-date; and
10.2.4 You will keep Your password confidential.
10.2.5 Your creation of a Worktaster Account is further affirmation of Your representation and warranty.
10.3 It is recommended that You do not share Your Worktaster Account details, particularly Your User name and password. We accept no liability for any losses or damages incurred as a result of Your Worktaster Account details being shared by You. If You use a shared computer, it is recommended that You do not save Your Worktaster Account details in Your internet browser.
10.4 If You have reason to believe that Your Worktaster Account details have been obtained by another person without consent, You should Contact Us at admin@worktaster.com immediately to suspend Your Worktaster Account. You must notify us in writing immediately if You become aware of any unauthorised use of Your Worktaster Account.
10.4 When choosing Your User name You are required to adhere to the terms set out in Clause 10.1 which may be amended by Worktaster from time to time. Any failure to do so could result in the suspension and/or deletion of Your Worktaster Account.

11. Termination and Cancellation of Worktaster Account

11.1 Either Worktaster or You may terminate Your Worktaster Account at any time. If We terminate Your Worktaster Account, You will be notified by email and an explanation for the termination will be provided. Notwithstanding the foregoing, We reserve the right to terminate, suspend or edit Your Worktaster Account without giving reasons.
11.2 If We terminate Your Worktaster Account, any current or pending Services on Your Worktaster Account will be cancelled and provision of Services will not continue. You will not be able to access Your Worktaster Account, Your Data, or Your Content after termination or cancellation.
11.3 We reserve the right to close Your Worktaster Account if it is inactive for a period of 24 months. You will need to create a new Worktaster Account to Access the Website if Your Worktaster Account has been closed due to inactivity.
11.4 You may cancel Your Worktaster Account on the Website at any time by using the Account Management section of the Website or by Contacting Us link[admin@worktaster.com] Your Worktaster Account will be cancelled and if You wish to use the Website again You will have to create a new Worktaster Account.

12. Services and Availability

12.1 Whilst every effort has been made to ensure that all general descriptions of Services available from Worktaster correspond to the actual Services that will be provided to You, We are not responsible for any variations from these descriptions as the exact nature of the Services may vary depending on Your individual requirements and circumstances. This does not exclude Our liability for mistakes due to negligence on Our part and refers only to variations of the correct Services, not different Services altogether
12.2 Where appropriate, You may be required to select the required Services.
12.3 We neither represent nor warrant that such Services will be available at all times.
12.4 All of Our Materials are correct at the time of going online. We reserve the right to change Our Materials and discontinue or alter or remove any of Our Services or special offers and to stop publishing Our Website at any time in Our sole discretion without notice or explanation and You will not be entitled to any compensation.

13. Your Worktaster Account, Provision of Services and Licence to use the Website and Our Material

13.1 To be eligible for a Worktaster Account on the Website You must be at least 13 years of age and resident in the UK and in full time education unless explicitly agreed.
13.2 You may register for a Worktaster Account on the Website by completing and submitting the online Worktaster Account Registration Form and clicking on the verification link in the email that the Website will send to You. After the verification process has been completed satisfactorily You will have access to the relevant Services.
13.3 Worktaster shall use all Our reasonable endeavours to source and supply Our Materials and the Services made available to You on the Website. However, in the case of information we obtain from Third Party sources (including Your Data and Your Content), we cannot guarantee that any of that information is correct, accurate, complete, error free or up-to-date.
13.4 Nothing provided by us on or in connection with the Website is, or shall be deemed to constitute financial, legal or other advice. The information we provide in Our Material is not intended to be relied on by you in making (or refraining from making) any specific decision or to replace independent professional advice. Any and all information provided by us in Our Material and on or in connection with the Website is for general information purposes only.
13.5 Business terms and conditions may apply to the provision of certain Business Services. If You are a Business Partner, Supplier and/or Affiliate of Worktaster You will be asked to read and confirm Your acceptance of any such Business terms and conditions when setting up Your Account. 14. Licence to use The Website

14.1 You may:
14.1.1 view pages from the Website in a web browser;
14.1.2 download pages from the Website for caching in a web browser;
14.1.3 print pages from the Website;
14.1.4 stream audio and video files from the Website; and
14.1.5 use the Website Services by means of a web browser,
14.1.6 use Worktaster social media, news and Youtube Services, [accessed via the Website] in accordance with these terms and conditions subject to the other provisions of these terms and conditions.
14.2 Except as expressly permitted by Clause 14.1 or the other provisions of these terms and conditions, You must not download any material from the Website or save any such material to Your computer.
14.3 You may only use the Website for Your own personal or (or in the case of Business Partners and/or Affiliates for business purposes), and You must not use the Website for any other purposes.
14.4 Except as expressly permitted by these terms and conditions, You must not edit or otherwise modify any material on the Website.
14.5 Unless You own or control the relevant rights in the material, You must not:
(a) republish material from the Website (including republication on another website);
(b) sell, rent or sub-license material from the Website;
(c) show any material from the Website in public;
(d) exploit material from the Website for a commercial purpose; or

14.6 Notwithstanding Clause 14.5, You may redistribute Our news section] in print and electronic form to any person.
14.7 We reserve the right to monitor social media and Youtube content submitted by You and posts may be removed or edited at Our discretion.
14.8 We are not responsible for the content of social media posts in any way whatsoever. In particular, we do not guarantee the accuracy, integrity or quality of such user submitted content. You agree that Worktaster has no responsibility or liability for the deletion or failure to store any messages that You post on any of our services.
14.9 We do not generally monitor our social media, however if You consider anything on the Website social media to be in breach of these terms and conditions You are requested to alert the moderation team using admin@worktaster.com.
14.10 When You register for membership You additionally agree to use Worktaster and it’s social media and Youtube channel in accordance with our rules that outline appropriate levels of behaviour when posting messages and the subject areas that may be discussed.
14.11 We reserve the right to restrict access to areas of the Website, or indeed the whole Website, at Our discretion; You must not circumvent or bypass, or attempt to circumvent or bypass, any access restriction measures on the Website without Our express written consent.

15. Acceptable use

15.1 You must not:
15.1.1 use the Website in any way or take any action that causes, or may cause, damage to the Website or impairment of the performance, availability or accessibility of the Website;

16. Your Content: Licence to Worktaster

16.1 In these terms and conditions, "Your Content" means all works and materials (including without limitation text, graphics, images, audio material, video material, audio-visual material, scripts, software and files) that You submit to us or the Website for storage or publication on, processing by, or transmission via, the Website.
16.2 You grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, store, adapt, publish, translate and distribute Your Content in any existing or future media / reproduce, store and publish your content on and in relation to this website and any successor website / reproduce, store and, with Your specific consent, publish Your Content on and in relation to the Website.

18. How We Use Your Personal Information (Data Protection)

18.1 All Data including personal information that We may collect (including, but not limited to, Your name, age, gender, email and postal address) will be collected, used and held in accordance with the provisions of the Data Protection Act 1998 and Your rights under that Act.
18.2 The Managing Director of Worktaster is registered with the Information Commissioner. As Data Controller of the information you provide we are responsible for complying with the Data Protection and Freedom of Information Acts. 18.3 Data from visitors to this Website is only collected if it is volunteered to us. Worktaster may collect information from you via the Website, the face to face service or via telephone. When you provide us with your personal Data through any of the routes described, you consent to the processing of all such personal data as set out in these Terms and Conditions. Please read the Terms and Conditions carefully and revisit this page from time to time to review any changes that we may have made.

19.1 We make no warranty or representation that the Website will meet Your requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be complete or accurate or up to date. We make no guarantee of any specific results from the use of our Services. For example the Website may not display or operate correctly if You access it using a mobile phone or similar device.
19.2 No part of this Website is intended to constitute advice and Our Material on this Website should not be relied upon when making any decisions or taking any action of any kind.
19.3 Whilst We use reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, You are strongly advised to take responsibility for Your own internet security, that of Your personal details and Your computers by using appropriate firewall and anti virus software where necessary.

22.2 Worktaster accepts no liability in contract, or for negligence or otherwise for any direct, indirect or consequential loss or damage suffered by you as a result of loss of access to the Website, due to routine or emergency maintenance on the system, or due to excessive demand for the Services, loss of Data including both Data sent and other Data held by or on behalf of You, delay or failure in receipt of Data provided by You, or the use of the Website.
22.3 Nothing in these terms and conditions excludes or restricts Worktaster’s liability for death or personal injury resulting from any negligence or fraud or fraudulent misrepresentation on the part of Worktaster.
22.4 Nothing in these terms and conditions excludes or restricts Worktaster’s liability in any way that is not permitted under applicable law.
22.5 In the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.
22.6 To the extent that Our Website, Services and Our Material is provided free of charge, We will not be liable for any loss or damage of any nature.
22.7 We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.

23. No Waiver
